Compensation for Developing Asthma Awarded to Children after Hearing

Two children, who developed breathing difficulties due to a shower drain being incorrectly fitted during renovations to their family home, have had settlements of compensation for developing asthma approved after a hearing at the Circuit Civil Court.

Circuit Court President, Mr Justice Raymond Groake, heard that eleven-year-old twins Abby and Chloe Croke started to experience breathing difficulties after improvements had been made to the family home in Raheny in Dublin in 2008.

Despite extensive investigations, it was three years before the incorrectly shower drain was identified as the cause of the problem – during which time Chloe had been diagnosed with asthma.

The family immediately made arrangements to have the shower drain re-aligned, and a compensation claim for developing asthma was made on the two girls´ behalf against Alpha Engineering Heat Providers Ltd of Finglas, Dublin by their mother Ita Croke.

Judge Groarke was told that Alpha Engineering Heat Providers Ltd had agreed to settle the claims for compensation for developing asthma without admission of liability and, after hearing that the Croke family were in agreement with the offer, he approved the settlement.
