A man who sustained radial nerve damage when his arm was struck by a pub door while he was on a night out in Dublin has been awarded 35,000 Euros in compensation for injury due to faulty door.
Radoslaw Wojtkow (31) from Dundrum in Dublin had been leaving The Living Room pub on Cathal Brugha Street on May 27th 2009, when an emergency door which was used at busy times to allow extra customers in and out of the premises fell from its hinges and caught Radoslaw on the arm.
A medical examination the next day revealed no fracture to the arm but, as the pain continued, Radoslaw sought the advice of a neurologist who conducted a scan on his arm and diagnosed an injury to the radial nerve.
After seeking professional legal advice, Radoslaw made a claim for injury due to faulty door against Murraywalsh Ltd – the owners of The Living Room. Murraywalsh Ltd failed to respond to the complaint made against them and a summary judgement was achieved in favour of Radoslaw.
Mr Justice Matthew Deery at the Circuit Civil Court in Dublin heard that the case was before him for assessment of damages only and, after considering the medical evidence, awarded Radoslaw 35,000 Euros in compensation for injury due to faulty door.
