A young girl, who was burned when a customer spilled a cup of tea on her, has had a settlement of compensation for being scalded in Burger King by Hot Tea approved by the Circuit Civil Court.
Jade Boylan (9) from Arbour Hill in Dublin, was visiting the Burger King restaurant in the Omni Shopping Centre when she was just seven and a half years of age in December 2011; when a cup of hot tea was spilled onto her shoulder by a customer who had bumped into her.
Jade was taken to the Casualty Department of the Temple Street Children´s Hospital, where medical attention was provided for a second degree burn to her left shoulder. Jade had the wound cleaned and dressed, but the swift medical treatment and a course of antibiotics failed to prevent a permanent scar from developing on her shoulder.
Through her father – Michael – Jade made a claim for being scalded in Burger King by hot tea against the restaurant alleging that, in addition to her physical injuries, she also developed a fear of boiling kettles.
Mr Justice Matthew Deery, sitting at the Civil Circuit Court, was told that the restaurant had made a settlement offer of €14,000 in compensation for being scalded in Burger King by hot tea and the family had been recommended to accept it. After hearing evidence from Michael Boylan about Jade´s accident, the judge approved the settlement.
