Cut Thumb Glass Injury at Work Compensation Awarded to Employee

A sales assistant in Galway, who suffered lacerations to her thumb from broken glass while removing rubbish, has been awarded €6,050 in cut thumb glass injury at work.

Boguslawa Dzienia (38) from Galway made her claim for cut thumb glass injury at work after suffering her injury while assisting to remove rubbish in the drapery stock room at the Dunnes Store Westside in Galway.

Boguslawa informed Judge Matthew Deery at the Circuit Civil Court that she had been holding open a rubbish bag while a colleague was placing another rubbish bag inside of it. However, a piece of glass caught the back of her thumb and cut it.

Dzienia had been taken to Galway University Hospital, where her thumb was x-rayed and treated to ensure that there was no glass remaining in it. It was then cleaned and closed with glue.

However, Boguslawa found that she had difficulty in everyday tasks and gripping things because of her injury and, after seeking legal counsel, she made a claim for broken glass injury at work compensation against her employers.

Her employers, Dunnes Stores, denied negligence and liability for her injuries and contested the compensation claim on the grounds that the medical report had recorded a quarter of an inch laceration which required minimal care following the accident.

On being told that the cut had healed fully, and the scar on Ms Dzienia’s thumb could only be seen on very close inspection, Judge Deery awarded Boguslawa €6,050 in cut thumb glass injury at work.
